LEGACY POINTS TERMS OF USE

Effective Date: February 13, 2023

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE LEGACY POINTS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR PARTICIPATE IN THE LEGACY POINTS PROGRAM.

These Terms of Use include negotiation and conciliation provision that governs any disputes between you and us. This provision may:

• eliminate your right to a trial by jury; and
• substantially affect your rights, including preventing you from bringing, joining, or participating in class or consolidated proceedings.

You agree that we may provide updates, notices, disclosures, and amendments to these Terms of Use, and other information relating to the Legacy Points program by electronic means, including posting such information and materials online on the Fellowship Portal.

ADDITIONAL TERMS

These Terms of Use apply to your access to, and participation in, the Legacy Points program (“Legacy Points”), which is operated by The ROOM or its respective subsidiaries, licensees and affiliated companies. These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with rewards for other products or services.

CHANGES TO TERMS

The ROOM reserves the right to change or modify these Terms of Use or any policy, FAQ, or guideline pertaining to Legacy Points, in whole or in part, at any time and in its sole discretion. Any changes or modifications will be effective immediately and may be posted, so please check back from time to time and we will alert you of updates. You waive any right you may have to receive specific notice of such changes or modifications, and your continued access to or participation in Legacy Points following any such changes or modifications confirms your acceptance. If you do not agree to these Terms of Use, you must stop accessing and participating in Legacy Points.

PERSONAL USE

Legacy Points is intended for personal use only. Commercial use is prohibited. Legacy Points are not targeted towards, nor intended for use by, anyone who is not eligible or part of the Fellowship Community.

Our Privacy Statement is incorporated into these Terms of Use and also governs your participation in Legacy Points. Please read the Privacy Statement carefully to understand how Legacy Points collects, uses and discloses information about customers, how to update or change your personal information, and how we communicate with you.

ABOUT LEGACY POINTS

Legacy Points is one way in which The ROOM endeavors to reward and thank loyal customers for engaging in the Fellowship. Fellows are able to earn and accumulate “points” that can be redeemed for Rewards. Unfortunately, not all locations have all the rewards at this time. Some rewards are location specific.

JOINING LEGACY POINTS

To join Legacy Points, you must complete or be actively participating in an ALX Programme and follow the prompts that will be made available to you to create your Fellowship account. 

When you join Legacy Points, you may have only one (1) account that is personal to you.

EARNING POINTS

The rewards that are available to you through Legacy Points are based on the number of points that you earn. You can earn points in some of the following ways:

1. Upload your CV onto your profile 
2. Self- Reporting (Max 4 per 1 year period/ once every 3 months)
3. Pitch Video Completion
4. Event created/hosted by a Fellow
5. Fellowship Assessment Completion 
6. Complete an ALX Programme
7. Log-on to portal/ Circle for the first time 
8. Attend virtual event 
9. Attend In-Person event 
10. Post on Portal (min 5 per month – max 10 per month)
11. Comment on Portal (min 10 per month – max 20 per month)

RETURNS

POINTS EXPIRATION

Unless otherwise noted, points are automatically added to your account for your eligible action and expire 18 months after the calendar month in which such points were earned. For example, if you earn points on January 15, 2023, they will expire on August 1, 2024. The oldest accrued points will be used first for redemptions. You can view and track your points balance and available rewards, as well as any additional benefits for which you are eligible as a fellow, on the member portal.

REDEEMING POINTS FOR REWARDS

Points may be redeemed for rewards. Legacy Points offer different rewards based on how many points have been accrued. Note that the rewards available may vary by location and by country and that The ROOM may adjust the items included in each tier at any time at its sole discretion. 

POINTS REDEMPTION AVAILABILITY MAY VARY

Not all locations have the ability to honor points redemption of all the rewards listed. Additionally, the items available for redemption at each Legacy Points milestone may vary. Depending on availability and logistics, certain locations may only offer rewards for fewer points than others. At such locations, and notwithstanding anything to the contrary in these Terms of Use, you will be eligible to redeem only the points that the rewards in the location will allow you to redeem.

OTHER IMPORTANT STAR REDEMPTION INFORMATION AND EXCLUSIONS

Points may be redeemed for products listed only. Note that redemption exclusions may apply. Depending on the location of where the rewards are redeemed, the availability and all other implications applicable to that country and the specific city will apply.

OTHER IMPORTANT INFORMATION YOU SHOULD KNOW

There are currently no participation or fees associated with Legacy Points. Points accrued in connection with Legacy Points, have no cash value and cannot be redeemed for cash. In addition, your redemption of points accrued in connection cannot be combined with any other offers or discounts, unless otherwise expressly indicated by The ROOM.

Your Legacy Points and fellowship profile is personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one (1) account that is personal to you.

Without notice to you, The ROOM reserves the right to suspend your account and/or terminate your account and/or your participation in Legacy Points if The ROOM determines, in its sole discretion, that you have violated these Terms of Use or that the use of your Legacy Points is unauthorized, deceptive, fraudulent or otherwise unlawful. The ROOM may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation in Legacy Points is terminated, all accrued points in your account are void.

Without notice to you, The ROOM also reserves the right to “unregister” and make ineligible for Legacy Points any account that has been inactive for two (2) consecutive years. Inactivity is defined as no points earned during such two (2) consecutive year period. In the event that your Legacy Points Card or account is unregistered or rendered inactive, all accrued points in your account are void.

The ROOM reserves the right to change, modify, discontinue or cancel Legacy Points or any part of the Legacy Points program, at any time and in its sole discretion, without notice to you.

DISPUTE RESOLUTION

Please read this section carefully. It affects rights that you may otherwise have. It provides for the resolution of all disputes arising from this agreement through negotiation. In the unfortunate event that a dispute arises between You and Us, we will appoint representatives to meet and resolve the dispute in good faith. This provision applies to all claims and disputes arising from these Terms of Use, the Legacy Points and your relationship with Us. In the event that disputes remain unresolved  sixty (60) days from the start of the negotiations, the courts of the Republic of Mauritius will have jurisdiction over them.

GOVERNING LAW

Any dispute arising from these Terms of Use or your access to or participation in Legacy Points will be governed by and construed and enforced in accordance with the laws of the Republic of Mauritius, without regard to conflict of law rules or principles. 

SEVERABILITY

If any provision or part of a provision of these Terms of Use is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
